Borrower’s Agreement & Waiver
Prior to borrowing tools, you must be 18 years of age or older, and:
Become a Member and complete a membership application at https://salmonconfluence.org/tools
Sign this ‘Borrower’s Agreement & Waiver.’
Present your signed Agreement and Waiver to a Creative Confluence staff member.
Have a credit card, debit card, or check on file with the Creative Confluence.
One membership consists of up to four people from the same household.
Creative Confluence staff and representatives are available to assist in explanation of operation of tools. However, by taking possession of any tool/item, the Member is certifying that he or she is capable of using that item in a safe and proper manner.
Only the Member and/or those listed on the household membership are authorized to use Tool Library tools. The Member(s) shall not permit the use of items by another person unless by the express permission of the Creative Confluence.
Members shall be subject to a deposit on certain tools.
All tools borrowed are to be returned to the Tool Library by close of business on their due date and checked in by Creative Confluence staff. Tools may be returned during open hours at the Tool Library, or by appointment with a Creative Confluence representative.
If the tool is returned late, the Member will be responsible for a late fee.
Late fees: $5/day that the Tool Library is open; fees are capped at the full replacement cost of the tool plus a $10 administrative fee.
The Creative Confluence may replace severely delinquent items, holding the Member responsible for the full replacement cost plus a $10 administrative fee.
Fines must be paid in full before borrowing additional items.
The Creative Confluence reserves the right to use appropriate steps to retrieve delinquent tools or unpaid fines and fees, including the use of a collection agency and/or legal action and to assess the delinquent Member with the cost of any such action. The Creative Confluence also reserves the right to forgive fees due to special circumstances. The credit card/debit card/check on file with the Creative Confluence may be used to reimburse the Tool Library for any tools that are not returned, are damaged, and/or are returned late.
Tools may be reserved only on the actual date of checkout. All reservations must be confirmed by a Creative Confluence representative. Reservations will be nullified if not checked out by the end of the business day the item was reserved for.
Members may renew each tool if:
The Member contacts the Tool Library by noon on the day that the tool is due.
No other Member has reserved the tool.
The Creative Confluence reserves the right to refuse or limit renewals and will do so based on demand.
The Member agrees that the Creative Confluence is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.
The Member agrees that if any borrowed tool becomes unsafe or in a state of disrepair, they must immediately stop use of the tool and notify the Creative Confluence of the issue on or before return.
All tools are to be returned in the same (or better) condition as they were issued, barring normal wear and tear. All tools must be returned clean. The Member agrees to pay for the loss of or damage to any item, to accept the Creative Confluence’s assessment of condition of items, and to agree to the Creative Confluence’s fair restitution for damage, dirtiness, delinquency, and/or loss of items in part or in total. This restitution amount could equal the full replacement cost for the item plus a $10.00 administrative fee.
The Creative Confluence reserves the right to refuse the loan of any item at its discretion.
I, ( ), have read and fully understand the Borrower’s Agreement & Waiver, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me.
I, ( ), state that I am capable of using the tools I am borrowing and that I will use the tools in a safe and proper manner.
I, ( ), do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against the Creative Confluence for any injury or injuries of any nature that I may suffer or incur in the use of tools that I am borrowing from the Creative Confluence.
I, ( ), hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless the Creative Confluence, their officers, agents, volunteers, and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arise or may arise or be occasioned in any way from the use or possession of tools I am borrowing from the Creative Confluence.
